It is against LBNL policy to transmit Protected Information, such as Personally Identifiable Information (Social Security Numbers, Financial Account Numbers, Personally Identifiable Health Information) via insecure means (such as email). Unless explicitly noted otherwise, the systems you are accessing have a FIPS 199 rating of Low/Low/Low. By using the eProject Builder system, you agree to limit distribution of information contained in the eProject Builder system to only staff at government agencies, private companies, and other organizations to whom you have authority from your Contracting Officer or Contracting Representative to distribute such information.
Data that are first produced under the U.S. Department of Energy’s Energy Savings Performance Contract (ESPC) Indefinite Delivery-Indefinite Quantity (IDIQ) contracts are subject to unlimited rights. If your data submission was produced under another type of contract or if you have questions regarding rights in the data you submit to eProject Builder or regarding how the data you submit to eProject Builder might be disseminated by the party with which you have contracted, please contact your Contracting Officer or Contracting Officer Representative.
Based on information that has been and will be provided by users of eProject Builder, the project data delivered to LBNL have commercial value whose disclosure would cause competitive harm to the commercial value or use of the data. LBNL intends to withhold such data from disclosure under 10 C.F.R. 1004.3(e)(2). Unless compelled by a court of competent jurisdiction, LBNL will not release eProject Builder data to the public without the consent of the parties to the project contract with the exception of aggregate data that does not identify individual project information.
National Association of Energy Service Company (NAESCO) Accreditation Committee members have limited access to project data self-selected and submitted into eProject Builder by companies seeking national accreditation. All members of the NAESCO Accreditation Committee are covered under a pre-existing non-disclosure agreement with NAESCO protecting the commercial value of this data.
